In re

John Kennedy deceased.

In the name of God Amen, I John Kennedy of Fresh Water Road near Saint John’s in the Island of Newfoundland make this my last will and testament. Imprimis I commit my soul to the mercy of my Redeemer and my body I leave to the care of my brother William whom I appoint as my sole executor. I give and bequeath to my two sons to be equally divided between them my whole property personal and real as well as monies due to me and in case one should die before he come of age the whole shall be for the survivor but if both should die then all my property shall be equally divided between my two brothers William and Patrick. Item my will is that the children shall be left in the care of their mother who will have the produce of the farm and the interest received for any monies which may remain after my debts shall be paid and the expense of sickness and burial as long as she shall remain a widow subject nevertheless to the directions of my brother William whom I leave guardian over my children during their minority. As witness my hand in Freshwater aforesaid this first of September 1864 John X(his mark) Kennedy.
